Hubters WebAI Terms of Service

Introduction

These Terms of Service ("Terms") govern your access to and use of Hubters WebAI services, including the hubters-webai platform, npm package, website, apis and any other services provided by HubtersAI, LLC ("we", "our", "us", or "HubtersAI"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the services and we reserve the right to terminate your access for violation of these Terms.

1. Services Description

Hubters WebAI provides services that enable developers to integrate open source or licensed Web AI models into their websites through our npm package hubters-webai , which allows AI models to run directly in client browsers.

Our services include:

• The Hubters WebAI platform (webai.axolsai.com) — providing model documentations, model playground, usage management, downloads and more.
• Access to the hubters-webai npm package for integration of AI models into web applications.
• Conversion of AI models to web-runnable format behind the scenes.
• Access to a variety of Web AI models for client-side execution.
• Web AI worker scripts that run the AI models in the browser.
• Developer dashboard for monitoring usage and downloads
• And other related features or improvements that may be introduced over time.

We reserve the right to modify, suspend, or discontinue any part of our services at any time. We will provide notice of significant changes when reasonably possible.

2. Account Registration and Security

To access and use Hubters WebAI production services, you must create an account. Public services may be accessible without an account, but an account is required for production use of our WebAI services. When registering, you agree to provide accurate, current, and complete information about yourself and your business.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

While there are no specific age restrictions, users are preferably over 18 years of age. If you are under 18, you represent that you have the consent of your parent or guardian to use our services.

3. Pricing and Payment

Hubters WebAI charges fees based on the pay-as-you-go pricing model. Billing occurs at the end of each billing cycle based on actual usage. For detailed pricing information, please refer to our pricing page.

We use Stripe as our payment processor to securely handle all payments. HubtersAI, LLC does not store your full credit card or banking details on our servers.

By using our services, you agree to:

• Pay all fees associated with your account
• Provide current, complete, and accurate payment information
• Promptly update your payment information if it changes
• Accept the terms and conditions of our payment processor, Stripe

We reserve the right to change our pricing model in the future with 1 month noticing period in advance. Refunds are only provided if there is an error in our services. To request a refund, please contact us with details of the issue.

4. Cancellation Policy

You may cancel your subscription to Hubters WebAI services at any time through our billing page.

To complete the cancellation process, you must:

• Pay any outstanding balance on your account
• Access the billing page in your account dashboard
• Follow the cancellation instructions provided on the billing page

Upon successful cancellation, the following changes take effect immediately:

• API Access Revoked: All API keys and production auth tokens become invalid immediately
• Service Access Disabled: Loss of all pay-as-you-go related features
• Production Model Downloads Stopped: You can no longer download models in production
• Outstanding Payment: Any outstanding balance will be automatically charged upon cancellation to finalize your account
• Existing Models Preserved: Downloaded models continue working locally on your applications
• Permanent Action: This action cannot be reversed, though you can resubscribe at any time to restore services

5. Data Collection and Privacy

We collect limited data about your use of our services:

• Your account information including username, email, and basic information
• Download usage data for billing purposes
• Payment information (processed securely through Stripe)
• Technical information necessary to provide our services

6. Intellectual Property and Usage Restrictions

The Hubters WebAI services, including the npm package, AI worker scripts, and all AI models, are the property of HubtersAI, LLC or its licensors and are protected by intellectual property laws.

By using our services, you are granted a limited, non-exclusive, non-transferable license to:

• Access and download Web AI models ONLY through the hubters-webai npm package
• Integrate these models into your websites for client-side execution.

You are expressly prohibited from:

• Accessing or downloading AI models through means other than the hubters-webai npm package.
• Altering, modifying, or attempting to reverse engineer the npm package or AI worker scripts.
• Illegal access to or abuse of our AI worker scripts that run models in the browser.
• Redistributing, selling, or licensing the AI models, npm package, or worker scripts to third parties.
• Using the AI models for illegal purposes or to generate illegal content.

7. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Grounds for termination include, but are not limited to:

• Abuse of our API or services
• Unauthorized access to our WebAI models and WebAI worker scripts
• Illegal downloads of our WebAI models and WebAI worker scripts in production without paying
• Using our WebAI models and WebAI worker scripts for illegal purposes
• Hacking or reverse engineering our WebAI models and WebAI worker scripts
• Failure to pay fees

Upon termination, your right to use the services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination.

We reserve the right to pursue legal action against malicious actors and seek damages for any harm caused to our services, intellectual property, or business operations.

8. Limitations of Liability

To the maximum extent permitted by applicable law, in no event shall HubtersAI, LLC, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the services
• Any conduct or content of any third party on the services
• Unauthorized access, use, or alteration of your transmissions or content
• The performance or output of Web AI models

Our liability is limited to the amount you paid us in the past twelve months.

9. Disclaimer of Warranties

Your use of the services is at your sole risk. The services are provided on an "AS IS" and "AS AVAILABLE" basis. The services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

HubtersAI, LLC does not warrant that:

• The services will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The services are free of viruses or other harmful components
• The results of using the services will meet your requirements

10. Indemnification

You agree to defend, indemnify, and hold harmless HubtersAI, LLC and its licensors, service providers, employees, agents, officers, and directors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the services
• Your violation of the rights of a third party
• Your content or applications that integrate our services

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of significant changes to these Terms by posting the new Terms on our website and/or sending you an email.

By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the services.
